摘要(Abstract)：
随着社会经济之急速变迁,人民与政府间之互动关系日益频繁,人民向行政机关提起行政争讼事件因而倍增,关于行政行为之争讼法制益显重要。美国行政争讼救济制度在宪法及行政程序法等有关法律之主导下,结合历年美国联邦最高法院之裁判,实证经验非常完备,颇值吾人借镜。
